California Supplemental Privacy Notice

Effective March 1, 2024

The California Consumer Privacy Act of 2018 (“CCPA”) and California Privacy Rights Act of 2020 (“CPRA”) provide certain rights to residents of California. This additional California Notice (the “Notice”) supplements the information contained in our Privacy Notice and applies solely to individual residents of the State of California (“consumers” or “you”) using certain services provided by subsidiaries of Everi Holdings Inc. (including, but not limited to, Everi Payments Inc., GCA MTL LLC, Central Credit LLC, Everi Games Holdings Inc., Everi Games Inc., Everi Interactive LLC, as the context requires. For the purpose of this Notice, “Everi”, “we” and “us” refer to the applicable subsidiary of Everi Holdings Inc.

Unless otherwise expressly stated, all terms in this Notice have the same meaning as defined in our Privacy Notice or as otherwise defined in the CCPA.

Our Collection and Use of Personal Information in the Past 12 Months

When we use the term “personal information” in this Notice, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

In the last 12 months, we have collected the following information about consumers for the following purposes.

Categories of Personal Information Collected

  • Identifiers including your name, contact information, address, email, phone number, device identifiers, cookies, IP address;
  • California Customer Records such as address, name, phone number, and any information that identifies, relates to, describes, or is capable of being associated with, a particular individual;
  • Protected Classification Characteristics including information protected by California laws, such as gender;
  • Commercial Information including transaction amount, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies;
  • Biometric Information including but not limited to, imagery of the iris, retina, fingerprint, face, hand, palm, vein patterns, and voice recordings;
  • Internet/Network Information, such as website or application or advertisement browsing history;
  • Location Information, such as establishment, Geolocation Data, IP Address, device shared location, and Wi-Fi connection location;
  • Professional and Employment Information such as employment status, employment history and job titles;
  • Education Information, including level of education, degrees, certificates held, and institutions attended;
  • Inferences drawn from any of the information we collect to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes; and
  • Sensitive Personal Information including, but not limited to, as account log-in, debit card or credit card numbers in combination with any required security or access code, password or credentials, and religious or philosophical beliefs.

Business or Commercial Purposes for Which We Collected or Disclosed Personal Information

  • Performing Services, including processing or fulfilling orders and transactions, maintaining or servicing accounts, providing customer service, verifying customer information, processing payments, providing advertising or marketing services, providing analytics services, or providing similar services, and communicating to you about the same;
  • Confirming and Protecting your Identity, including verifying and validating your identity and the identificationinformation you present to us;
  • Data Security & Fraud Prevention, including detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity;
  • Regulatory Compliance, including collecting and processing personal information to ensure our products and services are compliant with all applicable laws and regulations, including tax laws and anti-money laundering (“AML”) and Know Your Customer (“KYC”) requirements related to gambling and financial services transactions;
  • Analytics, Research and Development, including undertaking internal research for new product development and generating inferences about customer preferences;
  • Quality and Safety Improvement, including activities to improve, verify, audit, or maintain the quality or safety of our games, products, services and devices;
  • Direct Marketing of our products and services to you by email, phone, SMS, MMS, and other channels; and
  • Third Party Marketing to you by third parties with which we share your personal information.

  • Consumer Devices:  information collected from the devices you use with our services;
  • Affiliates and Partners: from other sources such as Company affiliates and/or business partners; advertising providers; analytics providers; marketers; public data bases; consumer data resellers; researchers; payment processors; and surveys; and
  • Services Use: through your use of the Services.

In the last 12 months, Everi has not sold and does not “sell” personal information about our customers as most people would typically understand the term. However, with regard to certain information we collect about our customers, through our services, games and our website, we use this information to perform marketing and serve advertisements on behalf of third parties.

To Whom We Disclose Personal Information

As described in the “Disclosure of Information Collected” section of the Privacy Notice, we share personal information within Everi, and between Everi subsidiaries, and with a variety of recipients for business purposes.

For purposes of this CCPA Privacy Notice, “share” means that the information is shared for the purpose of allowing third parties to engage in cross behavioral marketing to you.

In addition to the categories of recipients identified in the “Disclosure of Information Collected” section of the Privacy Notice, we disclose personal information to, or allow access to personal information by, the following categories of recipients:

Identity Verification Providers. We use third parties to verify the validity of your presented identification and use biometric data solely for the purposes of confirming presented identification matches the individual presenting the identification. These third-party businesses may collect personal information directly from a browser or device through cookies or similar tracking technologies when a consumer visits or interacts with our websites, uses our apps or otherwise engages with us online. Retention Of Personal Data

We will retain your personal data for as long as needed for the uses set out in our Privacy Notice, or for as long as there is a legitimate reason for doing so to perform the business purposes for which you provided the information, until you otherwise request deletion of your data, and in accordance with our statutory retention requirements.  If you have created an account with us, we will retain your information for the active life of your account until you terminate your account. 

Biometric Information is only stored temporarily to confirm your identity and then deleted (e.g., certain of our services may compare a photographic image of your face to the image on your driver’s license, and then immediately delete the photographic image). 

Minors Under Age 16

We do not collect the personal information of consumers we know to be less than 16 years of age.

Your California Privacy Rights

As a California resident, you may exercise the following rights in relation to the Personal Information about you that we have collected (subject to certain limitations at law):

  • KNOW what personal information we have collected about you and how we use and share it.

 “Personal information” means information that identifies, relates to, or could reasonably be linked to a particular consumer or household.

  • LIMIT the use and disclosure of sensitive personal information we collect about you.
  • OPT-OUT of the sale of your personal information, and the right to opt-out of the sharing of your personal information for cross-context behavioral advertising.
  • CORRECT inaccurate personal information that we have about you.
  • EQUAL treatment. We will discriminate against you for exercising your CCPA rights.
  • DELETE personal information we have collected from you, and require that our service providers do the same (subject to some exceptions).

The Right to Limit Use of Your Sensitive Personal Information

You can direct us to only use your sensitive personal information (for example, your social security number, financial account information, or your precise geolocation data) for limited purposes, such as providing you with the services you requested.

The Right to Know

You have the right to request any or all of the following information relating to the personal information we have collected about you or disclosed in the last 12 months, upon verification of your identity:

  • The specific pieces of personal information we have collected about you;
  • The categories of personal information we have collected about you;
  • The categories of sources of the personal information we have collected about you;
  • The categories of personal information that we have disclosed about you to third parties for a business purpose, and the categories of recipients to whom this information was disclosed;
  • The categories of personal information we have sold about you, and the categories of third parties to whom this information was sold; and
  • The business or commercial purposes for collecting or selling personal information about you.

You can make a request to know up to twice a year, free of charge.

The Right to Request Deletion

You have the right to request the deletion of personal information that we have collected from you, and to require that the third parties we have shared it with also delete it, subject to certain exceptions in which we are required to retain such information, including compliance with other laws and court orders. We may maintain a confidential record of deletion requests solely for the purpose of preventing the personal information of a consumer who has submitted a deletion request from being sold, for compliance with laws or for other lawful purposes.

The Right to Correct Inaccurate Personal Information.

You have the right to request that we correct inaccurate personal information we maintain about you.  Once we receive a verified request to correct your inaccurate personal information, we will use commercially reasonable efforts to correct it.

The Right to Opt-Out of Personal Information Sales and Sharing      

You as a resident of California or Nevada have the right to direct us not to sell or share personal information we have collected about you to third parties now or in the future.

The Right to Non- Discrimination 

You have the right not to receive discriminatory treatment for exercising any of the rights described above. However, please note that if the exercise of the rights described above limits our ability to process personal information (such as in the case of a deletion request), we may no longer be able to provide you our products or services or engage with you in the same manner.

“Shine the Light”

We may sell or share information you provide to us to third parties.  However, Residents of the State of California may ask us to provide them with a list of the types of personal information that we have disclosed during the preceding year to third parties for their direct marketing purposes, and the identity of those third parties.

Not Track

Your browser may provide you with the option to send a “Do Not Track” signal to websites you visit. This signal is used to request that websites not send the requesting device cookies, but websites have no obligation to respond to such signal or to modify their operation. At the current time, our website is not programmed to recognize Do Not Track signals, so the website will not treat you differently if we receive such signals from your browser and we may not comply with Do Not Track settings on your browser.

How to Exercise Your California Privacy Rights

To make a Request to Access your Personal Information, a Request to Delete your Personal Information, a Request to Correct your Personal Information, Request to Limit Sensitive Personal Information, or a Request to Opt-Out of Sales and Disclosure of Personal Information:

To opt out of sharing of your personal information for direct marketing under California’s “Shine the Light” statute, use our Privacy Request Form at https://www.everi.com/privacy-notice/requests.  To request a notice disclosing the categories of personal information we have shared with third parties for direct marketing purposes during the preceding calendar year, email us at [email protected].

We will need to verify your identity before processing your request. In order to verify your identity, we may require matching identifying information you provide us to the information we maintain about you in our systems or a successful login to your account (as applicable).

We use good faith efforts to respond to a verifiable consumer request to know or to delete within forty-five (45) days after its receipt. If we need more time (up to 90 days), we will inform you of the reason and the needed extension period in writing.

You do not need to create an account with us to exercise your privacy rights. However, we may ask you to provide additional personal information so that we can properly identify you in our dataset and to track compliance with your opt-out request. We will only use personal information provided in an opt-out request to review and comply with the request. If you choose not to provide this information, we may only be able to process your request to the extent we are able to identify you in our data systems and authenticate you as authorized to receive the information.

Authorized Agent

California residents may use an authorized agent to make a CCPA privacy request on the resident’s behalf. To make a request on behalf of a Everi customer, the authorized agent must provide a copy of either (a) a letter signed by the customer authorizing the agent to submit a CCPA request on his or her behalf, or (b) a power of attorney, duly authorized and issued pursuant to California Probate law. The authorized agent must email one or both documents to [email protected]  and include a phone number where the agent may be reached during regular business hours.

Household Requests

Under the CCPA, members of a California household can jointly request access to personal information for the household or the deletion of all household personal information. To make a household request, each member must first submit an Access or Deletion request on an individual basis. After submitting the individual requests, each member must submit an email to [email protected] and request that their Access or Deletion requests be combined with the other members of their household.

Financial Incentives

We do not currently offer incentives in exchange for the retention or sale of personal information.

Updates

We may update this Notice from time to time and in the event, we make material changes to this Notice, we will provide notification via posting on our online services or mobile application, or through other relevant communication channels. All changes shall be effective from the date of publication unless otherwise provided in the notification.
